PETALING JAYA: An odd-job labourer, who spent the last four years behind bars on trial for rape, was stunned when the Sessions Court judge acquitted him after finding that the victim was still a virgin.

Suhaimi Salleh, 30, who had been remanded at the Sungai Buloh prison, took some time to regain his composure after hearing the verdict yesterday.

When asked about his feelings, he said he just wanted to go home and spend time with his elderly mother and seven siblings.

?I miss them very, very much,? said Suhaimi, his voice halting with emotion.

Suhaimi, who was arrested on Nov 5, 2003, thanked his lawyers Jagdish Kaur and Baldev Singh.

He was accused of raping the 15-year-old girl on a half-completed bridge near Lebuhraya Kesas in Jalan Medan 23 between 3.30am and 5am on Nov 4, 2003.

His 87-year-old mother said she believed her youngest son from the day he was charged in court.

?I just know that my son did not rape her. I am very happy for him,? she said, smiling broadly.

Judge Nurmala Salim said the prosecution failed to prove a prima facie case.

?The victim gave her evidence partially at the examination-in-chief stage.

?Her story (when she testified in court) was only up to when she was stopped by several men.

?The court did not know about other aspects,? said the judge.

Nurmala said the doctor who examined the victim stated that the girl was still a virgin and there had been no penetration.

Five witnesses had testified since 2004.
